Facebook Makes Alarming Changes to Terms, ASMP Breaks Down the Changes

Facebook has altered their terms of service to make it possible for companies that pay the social media network to utilize Facebook users’ content and likeness without compensation or permission. The changes are sure to alienate Facebook’s users in the creative community, who make a living from licensing their work and content.

Among the changes is this gem:

“You give us permission to use your name, and profile picture, content, and information in connection with commercial, sponsored, or related that content (such as a brand you like) served or enhanced by us. This means, for example, that you permit a business or other entity to pay us to display your name and/or profile picture with your content or information, without any compensation to you. If you have selected a specific audience for your content or information, we will respect your choice when we use it.”

ASMP created a handy Q&A about the new terms of use that helps break down the changes and what they mean for photographers.

This comes on the heels of the ASMP-led criticism of Instagram that was recently issued.

We have to wonder, at what point will a social network take the step to actually compensate the users that make it tick and protect them from unauthorized exploitation and surveillance? Seems to us like a network that figured out how to do that would find a community very quickly.

    You’re looking at this the wrong way ’round. The users are the commodity that the social networks are selling. Facebook doesn’t exist to provide people with a FREE service. Facebook is there to MAKE MONEY. They don’t make money by giving services away.

    Facebook doesn’t give a SHIT about the users. They have an agenda. To MAKE MONEY.

    Why can’t people come to grips with this? Instead of criticizing and complaining and crying about the terms of service, STOP USING THE SERVICE. It’s not rocket science.

    Ugh. That isn’t so awesome. I run a film photography community and I love sharing links to people’s work but after reading that I’m not inclined to do it as much which is sad because my community is full of incredibly talented photographers.

    I say, as an artist who was around making stuff long before the internet, tried and true methods of promoting your artwork still stand and I believe always will, however it seems to me that people have gotten lazy and have let social media take over the promotion and sales of their work. I don’t sell a damn thing online. I say if you want your work to sell and be known then start locally and small. Put your feet on the ground, start walking door to door and put some sweat into promoting your work. If you got the goods and talent, thats only 10% the rest is the REALLY hard work: being your own salesperson, agent, and accountant.

    Denny, I have to say it’s extremely tiresome to keep having to correct people – like you – who keep saying things like “Facebook is a free service”. NO, IT’S NOT. As with broadcast television, there are ads everywhere. There are ads in the borders, ads on the log-in page, and within our news feeds there are tons of “suggested pages” which are, of course, ADS. As with broadcast TV, you don’t actually pay for a delivery method, but you still pay with your eyeballs. Every media & marketing professional knows Facebook is no more free than the Internet itself is free. And by the way, there are hundreds of thousands of non-profits that have come to rely on Facebook as a means of networking & fundraising since the recession cut budgets to zip. Believe me, we are all scrambling to find another social network to use that will allow us the same instant contact with thousands of supporters. We are sick & disgusted with Facebook but for many of our organizations, human and/or animal lives would be at risk if we quit cold. Oh, and just so you know – they make us PAY to reach more than about 50 people now, so now, it sure as h3ll ISN’T FREE.

    This already affected me. A company called Newsle pulled my profile photo and sent it out in an email attached to a story that had nothing to do with me. It was about a boxer buying a $2.5 million dollar property. The credit on the photo was wrong, everything was false and inaccurate. It’s not just stealing your photo it’s total misrepresentation.

    A lot of creative friends of mine are getting tired of Facebook as a way to share their work. There are many other sites out there including this one that just went live a few weeks ago: http://foliosweep.com/ You can display your work/sell your work/share your work and look for work. Facebook is kinda yesterday. I mean I love it don’t get me wrong, I love keeping up with my friends and I even have a ‘work page’ but when it comes to my art pieces, I will never share that with FB.

    FB changed their core to making money over the last year.
    its really sucks that I have to pay so that my FB fans can see my news or that is shows up in their feed.
    they raised the cost of such at leat 200% over the past 9 month. it was $5.00 for 2500 people reach now it is $ 20.00. i think that is even the minimum pay now.
    should this not be default ..that it is seen by my fans who signed up for my fan page in the first place?

    and why they always make it so difficult to opt out of those alarming term changes. well yes bc they know that we a busy or lazy and wont change it.

    I also do like FB .. i like how i can stay in touch w/ my friends around the world but those terms are really alarming and if they need to make money why not share it w/ the people who are the core of this network: the users.

    There is really no choice if you are a professional artist/photographer/business owner today. You have to use Facebook. Just leaving because the TOS suck… good luck with that. Facebook knows it, and are forcing people to take it however they dictate it.

    This does open a huge door to any viable competitor, though… I would jump ship easily to one that puts it’s users’s rights first.

    This is all really a major bummer, I do like sharing my work on Facebook. I seriously appreciate the ASMP for looking into this and pointing it out. It is true, how can Facebook, Twitter and even now Flickr make money when much of their service is free – why should we expect they would serve these pages with out taking advantage some how. Which makes me think…what are the terms of use of Twitter and Flickr? I sure have been lazy and haven’t read them. I hear Instagram has the same policy as Facebook does. Does anyone off-hand know, or read anything about it? Yes, I should look into it, but I thought I would ask. :)

    Sorry, one more comment…I just had a small realization. Major network T.V. and product brands post up photos on Facebook all the time – does Facebook’s Terms of Use allow them to reuse photos of Mickey Mouse, or photos from “Breaking Bad”? Wouldn’t those networks be able to sue the pants off of FB for that? Or do they not care because it is more advertising because the images are so recognizable to the brand?

    I just deleted all my albums and images from my personal and business facebook. I will continue to post and put links to my other sites where the images are to share! Problem solved!

    or…we can put those beautiful copyright logos all over the images…augh what work. this digital world.
